All services are subject to the terms outlined in this document and any written agreements between Heza Realtors and the client.

2. Service Provision and Good Faith

All information, recommendations, and services are provided in good faith based on current market conditions and available data at the time of engagement. We strive to provide accurate and up-to-date information, but market conditions can change rapidly.

3. Legal Compliance

Heza Realtors ensures compliance with all applicable Ugandan laws and regulations, including but not limited to:

  • The Land Act
  • The Landlord and Tenant Act 2022
  • The Condominium Act
  • The Registration of Titles Act
  • Other relevant property and real estate legislation

However, we do not guarantee the outcome of any property transactions or legal proceedings.

4. Commissions, Fees, and Payment Terms

All commissions, fees, and any applicable discounts are subject to written agreements between Heza Realtors and the client. Payment terms may vary depending on the service provided and will be clearly outlined in your service agreement.

5. Client Responsibilities and Advisory

Property transactions and investments involve inherent risks. Clients are strongly advised to:

  • Seek independent legal advice before proceeding with any transaction
  • Obtain independent financial consultation
  • Conduct due diligence on all properties
  • Review all documentation carefully
  • Understand market risks and potential fluctuations

6. Legal Documentation and MOUs

All agreements, including Memoranda of Understanding (MOUs) for property ownership on behalf of clients, require legal review by a qualified Ugandan lawyer. Heza Realtors facilitates this process but strongly recommends independent legal counsel.

7. Limitation of Liability

Heza Realtors Limited is not liable for losses arising from:

  • Market fluctuations and economic changes
  • Legal disputes between parties
  • Third-party actions beyond our reasonable control
  • Changes in government policies or regulations
  • Force majeure events

Our liability is limited to the extent permitted by Ugandan law.

8. Property Investment Risks

All parties acknowledge that property investments carry risks, including but not limited to:

  • Market value fluctuations
  • Changes in local regulations
  • Economic conditions affecting property values
  • Potential legal complications

9. Confidentiality

We maintain strict confidentiality regarding all client information and transactions, except where disclosure is required by law or with explicit client consent.

10. Intellectual Property

All content on our website, including property listings, descriptions, images, and marketing materials, is the property of Heza Realtors Limited or used with permission. Unauthorized use is prohibited.

11. Website Usage

By using our website, you agree to:

12. Termination of Services

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
